Terms of Service
This agreement is made between any Website Managers, LLC Customer & Website Managers, LLC Website Managers, LLC is described from here on in as Website Managers and the customer as customer.
- Website Managers does not permit the hosting of sites which contain material on or about any of the following:
- Sex, Pornography, Hacking, Warez, Illegal Activity, Slander or Libel
- Sites that contain any information that is illegal, in breach of any copyright, encouraging crime, hate or racisism.
- Spamming of any kind by customer will result in immediate
termination of customer account. Spamming is hereby defined as the promotion
of any Website Managers service by any customer by any of the following methods:
- Sending of unsolicited e-mail
- Placing of multiple ads above stated limits on the same on BBS/Newsgroup/Classified site or any other web site whatsoever
- The placing of commercial ads on sites and or chat rooms which do not allow such advertisements.
- Spamming by a third party on behalf of any customer. This may result in termination of customer account without notice or refund.
Website Managers reserves the right to take legal action in order to reclaim any damages caused to Website Managers due to spamming activity by any customer at any time.
- Any threat, either direct or implied, made by any customer against Website Managers staff will result in immediate termination of customer account. Under this circumstance no refund will be given, and all incidents may be reported to the Police.
- Website Managers reserves the right to refuse service to anyone
for any reason whatsoever. Website Managers also reserves the right not to renew
any customer contract at the time it expires, without providing reason.
- On opening a new Website Managers account, the customer agrees this contract may be cancelled up to 30 days from initial account activation. After that time no refund will be given for the remainder of the paid service period. All acounts will be automatically renewed unless cancelled. All payments are due one month in advance and may be cancelled no later than 7 days before the billing date. The billing date is the same day of each month, starting with the day you created your account. Payment shall be by credit card using PayPal. The customer is responsible for providing Website Managers with a valid account number with which to make such payments. Should a customer account be declined on any billing date, that customer shall be notified via email and given no more than 10 days with which to provide Website Managers with a valid account number. Failure to provide Website Managers with payment after 10 days from the billing date will result in account termination. Reactivation of any previously terminated account will require a penalty payment of US $25.
- Customer agrees to abide by all local, state, provincial, national, federal or otherwise laws as dictated by their physical location.
- Customer agrees that Website Managers is not responsible for file back-up in any way. File back-up is the sole responsibilty of customer.
- Website Managers is not reponsible for any loss of service to any customer due to server malfunction or any other circumstance. Website Managers is also not responsible and shall not be held liable for loss of any customer income caused either directly or otherwise by technical or any other problems whatsoever.
- Customer agress that Website Managers shall be not held liable for any damages or data losses of any kind caused either directly or indirectly by Website Managers.
- 10. All Website Managers fees and prices, stated or otherwise, shall be made in United States Dollars only.
- 11. Website Managers is not liable for, and does not guarantee the privacy and or security of any information or data whatsoever transmitted in any form over through or from Website Managers servers.
- Customer agrees to hold Website Managers harmless from any and all claims made against the customer related to or arising from the customer's use of any Website Managers service.
- Website Managers reserves the right to change any and or all of these Terms at any time without reason or notice.
- Any Website Managers publication may include technical inaccuracies or typographical errors. Changes may be periodically made to these publications; these changes will be incorporated in new editions of these publications. Website Managers reserves the right to make improvements and or changes in the products and or the programs described in these publications at any time without notice.
- This Agreement shall be constructed and controlled by the laws of the State of Iowa, without regard to its conflict of law provisions. Any dispute arising hereunder will be governed by the laws of the State of Iowa, USA. Customer agrees to personal jurisdiction by the State and Federal Courts of the State of Iowa.
- 16. In the event that customer uses a mass emailing program such as ListMail for sending mail to more than 10,000 recipients at a time, the software must be properly configured to pause after a certain number of emails sent, or every 15 minutes and Website Managers must be notified before you begin mailing. Should the software not be properly configured and that activity causes technical issues with the server, customer will be charged the amount it costs Website Managers to have the problem corrected and the general operations of the server restored.
Any sites that are found to contain any of the listed and or banned information will be removed from Website Managers servers and no refund shall be given under these circumstances.
If customer's web site is removed due to violation of these terms, customer will be refused future hosting of any kind.
